FanActivate offers a variety of services that are collectively referred to as the “Service.” FanActivate collects information from individuals who visit FanActivate’s Internet website, fanactivate.com, (“independent advertisers”) and individuals who register to use the Service (“customers”).
Information That FanActivate Collects
FanActivate collects and stores personal information. Personal information means personally identifiable information, such as names, mailing addresses, phone number, email addresses, credit data, and other financial information.
FanActivate also collects and stores non-personal information. Non-personal information includes browser types, internet service providers and their location, the URLs of previous websites visited, operating systems, IP addresses, and the like.
How and When FanActivate Collects Information
How do we use this information?
FanActivate primarily uses your personal information for administering the Service and providing service and support to independent advertisers and to customers. For example, if a customer signs up to receive messages relating to an independent advertiser’s promotional campaign, FanActivate may use the cellular phone number, email address, and/or social media contact information the customer provided to us to send the customer relevant campaign messages. As another example, if an independent advertiser requires help with the FanActivate Services, a FanActivate employee may ask independent advertiser to confirm personal information, such as the independent advertiser’s name, address, or other relevant identifying information.
FanActivate primarily uses non-personal information to help FanActivate better understand how visitors use the Site and to provide a better experience for our visitors.
Given that the Internet is a global environment, using the Internet to collect and process personal information frequently involves the transmission of data on an international basis. By providing FanActivate with your personal information, you acknowledge and agree that FanActivate may store your personal information and transfer it to and from our servers located in the United States and throughout the world.

Is Personal Information Shared or Disclosed?
FanActivate is not in the business of selling personal information. We consider this information to be a vital part of our relationship with independent advertisers and customers. There are, however, certain circumstances in which we may share personal and non-personal information with certain third parties without further notice, as set forth below:
- FanActivate will disclose non-personal information, in aggregate form, to potential strategic partners, advertisers, investors, customers, and others. You may not opt-out of the sharing of this information. However, it cannot be easily used to identify you personally.
- FanActivate reserves the right to disclose information, including personal information, to third party governmental agencies or third parties in order to comply with applicable laws, regulations, legal processes or governmental requests (such as in order to comply with a subpoena or court order), to protect FanActivate’s rights, or to prevent, protect against, or investigate illegal activity such as credit fraud. For example, if an independent advertiser submits an advertisement to FanActivate, FanActivate may disclose the independent advertiser’s information to a third party that alleges that the independent advertiser has infringed the third party’s intellectual property rights. Similarly, if a third party alleges that an independent advertiser is infringing upon the third party’s intellectual property rights, we may disclose the third party’s information to that independent advertiser.
- FanActivate contracts with several partners to help manage, monitor, and optimize FanActivate’s business. For example, FanActivate uses a third party to process credit card payments. FanActivate may also subcontract out analytics, reporting, and/or other operations. Accordingly, FanActivate may need to share personal information with these partners so that the partners can provide the services in question. FanActivate will use commercially reasonable efforts to prevent such partners from disclosing your personal information, except for the purpose of providing the services in question. FanActivate cannot guarantee that such partners will not disclose your personal information.
- In the event FanActivate goes through a business transition, such as a merger, acquisition, or sale, your personal information will likely be among the assets transferred to a successor-in-interest. FanActivate reserves the right to transfer any personal and non-personal information to such successor-in-interest.
FanActivate endeavors to protect all personal Information collected through Site in a safe, confidential, and secure manner. To this end, FanActivate uses Secure Sockets Layer (SSL), an advanced security protocol that protects your credit card information and promotes secure online ordering. SSL Internet connections are encrypted, and may protect credit card ordering information, including your name, address, and credit card number, so it cannot be read in transit.
FanActivate also uses secure technology, privacy protection controls, and restrictions on employee access to safeguard personal information. FanActivate will hold any personal information sent to us securely in accordance with our internal security policy and the law. For example, customer information is securely stored on FanActivate’s list server that delivers the campaign messages. The customer information can only be accessed by FanActivate employees who help manage the lists in order to deliver messages to customers who have registered for the FanActivate Service. FanActivate will at no time collect or redistribute your personal information without your consent, except as detailed in this Policy.

The Site and the FanActivate Service is intended for adults. FanActivate does not knowingly collect personal information from children under the age of 13. Nevertheless, if the parent or guardian of a child under 13 believes that the child has provided us with personal information, the parent or guardian of that child should contact us if they want this information deleted from our files so that it is not in retrievable form. If FanActivate otherwise obtains knowledge that FanActivate has personal information about a child under 13 in retrievable form in our files, FanActivate will delete that information from our existing files so that it is not retrievable.
Reviewing and Making Changes to Personal Information
You can obtain a copy of and request that we correct errors in your personal information by contacting us. For your protection, you will be required to provide proof of your identity to obtain a copy of your personal information. If your personal information changes or if you no longer want to use the FanActivate Services, you may correct, update, or deactivate your personal information and/or your account by contacting us.

Opting Out of Communications from FanActivate
FanActivate wants to communicate with you only if you want to hear from us. All electronic communications that are sent to you by the FanActivate Service include an unsubscribe link in them. If, for any reason, you would no longer like to receive electronic communications from FanActivate, you can unsubscribe by clicking the unsubscribe link. You can also contact us at firstname.lastname@example.org to change your information at any time. Please note that, if you decide not to receive marketing emails from FanActivate, you may still receive “transactional” email messages (i.e. registration confirmation, customer service notifications, etc.). FanActivate operates "AS-IS" and "AS-AVAILABLE," without liability of any kind. FanActivate is not responsible for events beyond our direct control.
